1. DEFINITIONS; VENTURE YACHT CREW: Referred to as "we," "us," or "our."
Client / Vessel: Any individual, company, or vessel that employs or seeks to employ a candidate through Venture Yacht Crew.
2. SERVICES PROVIDED BY VENTURE YACHT CREW
Venture Yacht Crew will, upon request from the Client, provide professional candidates for yachting or household staffing roles. Our services are offered on an as-needed, day-to-day basis. The Client is solely responsible for specifying their requirements, including the candidate’s qualifications, duties, rates, and the minimum duration of service.
If, during the warranty period, the Client is not satisfied with a candidate’s performance, they may contact us in writing or by phone. We will, upon request, provide a replacement candidate free of charge who meets the required qualifications.
If a candidate resigns during the warranty period, we will provide a replacement free of charge. This does not apply if the candidate resigns due to discrimination or harassment in circumstances that fall outside the definitions and protections set out in the Maritime Labour Convention (MLC) 2006. In cases where resignation is due to discrimination or harassment as defined by the MLC 2006, the situation will be handled separately in accordance with the Convention’s standards.
3. PRIVACY STATEMENT
In accordance with applicable data protection laws, we inform you that any personal data provided will be processed in compliance with current legislation. Data may be disclosed to relevant public authorities or entities if necessary for service provision. Failure to provide this data may result in an inability to fulfil contractual services. Venture Yacht Crew ensures that all data will be processed lawfully, transparently, and accurately, and will take reasonable measures to delete or rectify inaccurate information.
Clients have the right to access, rectify, limit, delete, or oppose data processing by contacting us via postal address or email. We are committed to protecting your privacy, and only authorised employees will have access to client data.
4. CONFIDENTIALITY
All information provided by the Client to Venture Yacht Crew shall be treated as strictly confidential. Venture Yacht Crew agrees not to disclose, share, or use this information for any purpose other than to assist the Client in hiring a suitable candidate, and only with the Client’s prior written consent. This obligation of confidentiality shall continue indefinitely, including after the termination of any engagement or agreement between the Client and Venture Yacht Crew.
5. PROVISION OF DOCUMENTS REQUIRED BY MLC
To comply with the requirements of the Maritime Labour Convention (MLC) 2006 (A1.4, paragraph 5(c)(iv)), the Client must provide a copy of the vessel’s registration document and crew insurance policy before any candidates are introduced.
Venture Yacht Crew will verify each candidate’s identity, qualifications, and experience to ensure they meet the requirements of the role. Candidates must also be provided with their Seafarer’s Employment Agreement (SEA) for review both before and after signing, and a copy of the signed SEA must be forwarded to Venture Yacht Crew.
6. PAYMENT AND FEES
PAYMENT TERMS: Payment is due within 30 days of the invoice date. Failure to meet these payment terms will void any applicable warranties.
INCLUDED CHECKS: All fees include a criminal record check and certificate verification by CrewPass, if this has not been carried out in the previous two years.
PRICING AND WARRANTY:
PERMANENT AND ROTATIONAL CREW: 70% of one month’s salary (as per the seafarer’s SEA), with a 180-day replacement warranty.
SEASONAL CREW: Covered for the full season. Seasonal dates are to be agreed upon by the client and Venture Yacht Crew as specified in the contract agreement.
JUNIOR ROLES: Crew members with one stripe on their shoulder (e.g., Deckhands or Stewardesses, experienced or green) – flat rate of €1,000, with a 60-day replacement warranty.
If a candidate leaves the vessel or is dismissed during the warranty period, Venture Yacht Crew will provide a replacement free of charge. The replacement candidate will carry on under the remainder of the original warranty.
*Candidates with specialised skills, such as chefs, spa therapists, engineers, or similar, are not eligible for the discounted junior role fee unless agreed in advance.
TEMPORARY CREW PLACEMENT: Temporary crew for periods under one month are charged at 25% of the total salary based on a daily rate, with a minimum fee of €200. If the candidate transitions to a permanent or seasonal position, fees will be adjusted, deducting any temporary fees previously paid.
PAYMENT METHODS: Payments can be made via bank transfer; details will be provided on the invoice.
TAXES: All fees are exclusive of VAT and any other tax liabilities, which depend on the vessel’s registration and flag state.
7. DUPLICATE RESUMES
If the Client receives a duplicate resume for a candidate already known to them, they must notify us within 48 hours. Failure to do so will obligate the Client to pay the placement fee, regardless of other source of the candidate’s resume.
8. WARRANTY
Venture Yacht Crew offers a replacement guarantee for all crew placements. The warranty terms depend on the type of role:
PERMANENT AND ROTATIONAL CREW: A replacement is provided free of charge if the candidate leaves or is dismissed within 180 days of their employment start date as listed on the SEA.
SEASONAL CREW: Covered for the full season. The start and end dates of the seasonal placement will be agreed with the Client during the hiring process.
JUNIOR ROLES (Deckhands, Stewardesses, one-stripe crew): A replacement is provided free of charge if the candidate leaves or is dismissed within 60 days of their employment start date as listed on the SEA. Candidates with specialised skills, such as chefs, spa therapists, engineers, or similar, are not eligible for the discounted junior role fee unless agreed in advance.
CONDITIONS FOR WARRANTY:
Venture Yacht Crew must be notified within five days of the candidate leaving the vessel.
The Client must have complied with the terms of this agreement, including payment obligations.
For replacements, the new candidate will carry on under the remainder of the original warranty period.
The warranty covers a maximum of two replacement candidates per role.
ADDITIONAL TERMS: No cash refunds are offered under the warranty; only replacement crew members are provided.
9. DISCLAIMER
Venture Yacht Crew verifies the references provided by candidates and shares the results with the Client. The Client may, however, carry out additional checks or investigations as they deem necessary. Venture Yacht Crew accepts no responsibility for any actions, omissions, or damages caused by a candidate during their employment.
10. ENTIRE AGREEMENT
By accepting a candidate’s resume or referral, the Client agrees to be bound by the fees and terms set out in these Terms and Conditions. These terms are legally binding for a period of one year from the date the Client first receives the candidate information, regardless of whether a signed agreement is in place. A wet-signed copy of this agreement, signed by both parties, can be provided on request.
11. COMPLAINTS PROCEDURE
Venture Yacht Crew aims to provide exceptional service to both Clients and candidates. If a complaint arises, please email compliance@ventureyachtcrew.com with “Complaint” as the subject line. A company director will investigate the matter and respond with a proposed resolution within four weeks.
If the complaint remains unresolved, it may be escalated to the Maritime and Coastguard Agency (MCA) at mlc@mcga.gov.uk
Venture Yacht Crew will also forward any unresolved complaints to the MCA for further consideration.
